Notice of Non-Discrimination

The College District prohibits discrimination and harassment of any student on the basis of race, color, national origin, religion, sex, sexual orientation, gender identity or gender expression, disability, age, veteran status, genetic information, or any other basis prohibited by law.

Gender Discrimination and Sexual Harassment

Title IX of the Education Amendment and Brazosport College Policy specifically prohibits discrimination in services or benefits offered by the College based upon gender.  Brazosport College’s Policy FFD (Local) provides that students are to be free from gender discrimination, harassment, and retaliation. It can be found here: http://pol.tasb.org/Policy/Download/215?filename=FFDA%28LOCAL%29.pdf.

Sexual violence and sexual harassment are forms of gender discrimination and, therefore, are prohibited under Title IX. Sexual violence refers to physical sexual acts perpetrated against a person’s will or where a person is incapable of giving consent.  A number of different acts fall into the category of sexual violence, including rape, sexual assault, sexual battery, sexual abuse, and sexual coercion.

Sexual harassment includes, but is not limited to, unwelcome sexual advances, unwelcome requests for sexual favors, unwelcome verbal comments of a sexual nature, and physical contact or touching of a sexual nature. Conduct is unwelcome when it is not solicited by an individual and is regarded by him or her as unwanted or offensive. Sexual harassment is wrongful regardless of whether the parties are of the same sex or of the opposite sex. A violation of this policy occurs when the conduct is sufficiently severe or pervasive and:

a.       Submission to such conduct is explicitly or implicitly made a term or condition of employment, instruction, or participation in other College District activities;
b.      Submission to or rejection of such conduct is used as basis for personnel or academic decisions that affect the individual who has been subjected to sexual advances; and/or
c.       Such conduct has the effect of interfering with the individual’s work or academic performance or creating an intimidating, hostile, or offensive work or learning environment.

Any person (student, faculty, staff, or guest) who has questions on this topic or who believes that discriminatory practices have occurred based upon gender may discuss their concerns and file informal or formal complaints of possible violations of Title IX with any of the following individuals:
